Advertising Compliance & Principles Policy

This Advertising Compliance & Principles Policy (the “Policy”) applies to all advertising activities conducted through infrastructure, services, or advertising accounts provided by or associated with Almar Media Limited (the “Company”).

This Policy forms an integral and inseparable part of the Company’s Service Agreement, Terms of Service, and Purchase & Billing Policy.
Any breach of this Policy constitutes a material breach of the applicable agreements.

Capitalised terms not defined herein shall have the meanings given in the Service Agreement or Terms of Service.

1. FUNDAMENTAL PRINCIPLES

All advertisers must conduct advertising activities in a manner that is:

  • lawful, honest, and transparent;

  • compliant with Applicable Laws and regulations in all targeted jurisdictions;

  • compliant with the terms, policies, and guidelines of all relevant advertising platforms;

  • respectful of consumers, public trust, and market integrity.

The Company reserves the right to interpret and enforce this Policy at its sole discretion.

2. ADVERTISER OF RECORD

2.1 The advertiser using the Company’s infrastructure is the sole advertiser of record for all advertisements.

2.2 The Company does not create, review, approve, validate, or endorse advertising content.

2.3 All legal, regulatory, civil, and criminal liability arising from advertisements remains exclusively with the advertiser.

3. COMPLIANCE OBLIGATIONS

Advertisers are solely responsible for ensuring that all advertisements:

(a) comply with all Applicable Laws, including consumer protection, advertising, data protection, sanctions, and sector-specific regulations;
(b) comply with the advertising policies and enforcement standards of relevant advertising platforms (including Meta, Google, TikTok, Snapchat, Microsoft, and others);
(c) are accurate, substantiated, and non-misleading;
(d) include all mandatory disclosures, disclaimers, and warnings required by law.

The Company assumes no duty to verify or monitor compliance.

4. PROHIBITED ADVERTISING CONTENT AND ACTIVITIES

The following advertising activities are strictly prohibited:

4.1 Illegal or Deceptive Practices

  • fraud, scams, or deceptive offers;

  • misleading claims, fake testimonials, or false scarcity;

  • impersonation of brands, individuals, or institutions.

4.2 Circumvention and Abuse

  • attempts to bypass advertising platform enforcement or review systems;

  • cloaking, hidden redirects, or mismatched creatives and landing pages;

  • repeated use of replacement accounts following enforcement actions.

4.3 Restricted or Regulated Verticals (Without Explicit Approval)

  • financial products or investment schemes lacking required licensing;

  • medical, pharmaceutical, or health-related claims without regulatory approval;

  • gambling, betting, or gaming services where unlawful or unlicensed;

  • cryptocurrency or digital asset promotions without proper authorisation.

4.4 Harmful or Unacceptable Content

  • content that is discriminatory, hateful, obscene, violent, or exploitative;

  • targeting minors inappropriately or unlawfully;

  • promotion of counterfeit, pirated, or stolen goods.

5. PLATFORM POLICIES PREVAIL

Advertising platforms retain final authority over:

  • advertisement approval or rejection;

  • account suspensions, restrictions, or terminations;

  • interpretation and enforcement of their policies.

The Company shall not be liable for any platform action, including suspension or loss of advertising access.

6. MONITORING AND ENFORCEMENT RIGHTS

6.1 The Company reserves the right, but does not assume any obligation, to:

  • review advertising activity at a high level for risk assessment;

  • restrict, suspend, or terminate access where risk is identified;

  • require modification or removal of advertisements.

6.2 Enforcement actions may be taken without prior notice and without liability to the advertiser.

6.3 The Company is under no obligation to provide justification or evidence for enforcement decisions.

7. SUSPENSION, TERMINATION, AND CONSEQUENCES

Where a breach of this Policy is suspected or identified, the Company may:

  • immediately suspend or terminate services;

  • restrict or revoke access to advertising accounts;

  • withhold or retain funds to cover potential liabilities;

  • report conduct to advertising platforms, financial institutions, or authorities.

All decisions are final.

8. INDEMNIFICATION

Advertisers shall fully indemnify and hold harmless the Company, its directors, officers, employees, affiliates, and partners from any claims, losses, penalties, fines, damages, or costs (including legal fees) arising from:

  • advertising content or activities;

  • violations of this Policy;

  • enforcement actions by advertising platforms or regulators.

9. NO WAIVER OF RIGHTS

Failure by the Company to enforce any provision of this Policy shall not constitute a waiver of its right to enforce such provision in the future.

10. GOVERNING LAW

This Policy shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
